Who pays the property agent commission in Hong Kong?
By convention, both the buyer and the seller each pay their own agent a commission, commonly about 1% of the transaction price each, so the total is often around 2%. The seller pays the listing agent, the buyer pays the purchasing agent. The exact rate is negotiable and stated in the agency agreement.
Does the 1% rate apply to all properties?
No. The 1% is just a common market reference; it varies with property type, price and market conditions. Luxury or large deals may be negotiated lower; some small or off-plan deals differ. The Estate Agents Authority's Code of Practice sets conduct rules, not a fixed rate, so always confirm the percentage in writing.
Is the commission calculated on the transaction price or the loan amount?
On the property's transaction price (the consideration), not on the mortgage loan. The agent is paid for facilitating the deal, so the commission base is the sale/purchase price. Stamp duty, furnishing and loan amounts are not part of the commission base.
Besides the commission, what other costs should I budget for?
On top of agent commission, budget for stamp duty (including the possible Buyer's Stamp Duty and Ad Valorem Stamp Duty for non-first-time or non-resident buyers), solicitor fees, mortgage-related charges and moving costs. The total can be several percent of the price, so plan the full cash needed, not just the commission.
How should I use the agent agreement and commission to protect myself?
Sign a written agency agreement that states the commission rate, scope and validity period; the Estate Agents Authority requires clear terms and a cooling-off period. Before signing, compare a few agents' rates and services, confirm whether the fee is 'success-only' (payable only on completion), and beware of double agency or hidden charges.
